Pune: A family court in Pune has ruled in favor of an elderly couple who sought financial support from their son, ordering him to pay ₹16,000 per month in alimony. The court rebuked the son for refusing to provide financial assistance, stating that caring for one’s parents is both a moral and legal responsibility.
The senior couple filed a petition in March 2023 at the Shivajinagar Family Court, arguing that their son, who earns a good salary, had abandoned them. The couple has three daughters and one son. Despite spending on his education and ensuring his well-being, the son refused to support them financially.
The elderly couple, suffering from diabetes, heart disease, and paralysis, stated that they only receive ₹1,300 as a pension and are now forced to live with their son-in-law. Through their legal representatives, Adv. Janhavi Bhosale and Adv. Bhalchandra Dhapte, they demanded ₹16,000 per month in financial assistance.
Son’s Defense: Claims of Financial Strain
In response, the son opposed the petition, citing financial constraints. His lawyer presented the following arguments:
His monthly salary is ₹60,000, but he has several financial commitments.
He has to support his wife and parents.
He has loan EMIs, electricity bills, and daily household expenses.
He bought a car on EMI due to vertigo issues.
He had transferred some money to his father last year and claimed that his parents were intentionally harassing him.
After reviewing both arguments, Judge K. V. Thakur ruled in favor of the elderly parents. The court emphasized that caring for parents is not only a moral duty but also a legal obligation. The court ordered the son to pay ₹16,000 per month, with ₹8,000 allocated to each parent.
