Pune: Here’s why flat owners in housing societies are being deprived of their ownership rights

Pune: Is your housing society constructed on two or more plots with different owners? Then even though the Pune Municipal Corporation has approved it, you may not get a property issued in your name. Why? Because of the archaic provisions of the Maharashtra Land Revenue Code. As a result, thousands of citizens are being deprived from getting their property card.

The Pune Municipal Corporation has permitted construction of housing societies on joint plots owned by more than one owner. Based on this permission, thousands of flats are being sold to citizens. However, when citizens take possession of these flats then they face many problems in obtaining conveyance deeds and property cards of their residence.

The section 87 of the Maharashtra Land Revenue Act prohibits the Land Records department from making an entry of land records in case the two or more plots have different owners. As a result, in such societies, the flat owners are being deprived of their ownership rights sans property card.

The Land Records Department has sent a proposal regarding amending the Maharashtra Land Revenue Act and allowing the department to issue property cards to flat owners even if the housing society is constructed on plots owned by two or more owners. This proposal is still pending for approval with the state government for the last two years.

A citizen, Sanjay Mahankal said, “We have a society in Kothrud and have applied for a conveyance deed for society and property cards. It was rejected. The Land Records Department gave reason that they are not allowed to do so since the plots on which the society has been constructed have different owners.”

Builders have demanded that the state government should immediately look into this matter. The state government’s decision will benefit thousands of flat owners in residential complexes in the city.
