Pune, 24 June 2025: The prosecution on Monday requested the Juvenile Justice Board (JJB) to allow the 17-year-old involved in the Porsche crash in Kalyani Nagar to be tried as an adult, citing the serious nature of the offences and the teenager’s understanding of their consequences. The board is expected to announce its decision on July 15.
During final arguments before Principal Magistrate Garima Bagrodia, Special Public Prosecutor Shishir Hiray said the teenager, officially classified as a Child in Conflict with Law (CCL), was driving under the influence of alcohol and is booked under Indian Penal Code Section 304 (culpable homicide not amounting to murder) and Section 467 (forgery) for allegedly tampering with blood samples.
“These charges carry punishments exceeding ten years, making them ‘heinous’ under the Juvenile Justice Act. The CCL was fully aware of the consequences and should face trial as an adult,” Hiray argued.
Defence lawyer Prashant Patil opposed the prosecution’s request, stating that the Juvenile Justice Act aims to prioritise rehabilitation and reform. He referred to a Supreme Court ruling to argue that the charges may not strictly qualify as ‘heinous’. “The board should consider the child’s capacity for reform. Trying him as an adult would defeat the purpose of juvenile justice,” Patil said.
The CCL, along with co-accused Shivani Agarwal and ACP Ganesh Ingale, was present during the hearing. The board has already reviewed reports from a psychological evaluation, a deaddiction centre, and a probation officer.
The crash on May 19, 2024, resulted in the deaths of two IT professionals and led to widespread public anger and scrutiny of the police investigation.
