Revenue Officials Accused of Violating PESA Act in Maharashtra

Concerns Raised Over Bypassing Gram Sabhas in Infrastructure Projects, Demands for Action Against Erring Officials

The Provisions of the Panchayats (Extension to Scheduled Areas) Act, 1996 (PESA) has once again come under scrutiny in Maharashtra, as allegations emerge against revenue officials for violating its mandates. The act, designed to empower Gram Sabhas in tribal areas, is facing challenges due to bureaucratic hurdles and mismanagement, undermining its core objectives of decentralisation and self-governance.

In the Ambegaon taluka, specifically along the Junnar-Ghodegaon-Talegaon stretch of National Highway 61, officials are accused of disregarding PESA guidelines. Instead of conducting proper Gram Sabha meetings, officials are allegedly drafting resolutions in advance and pressuring local leaders to sign them without adequate discussion.

The bypassing of Gram Sabhas undermines the autonomy and decision-making authority of tribal communities, contrary to the spirit of PESA. This approach can lead to projects being implemented without considering local needs or environmental impacts.

Activists, including Ravindra Talpe, President of the Adivasi Suraksha and Vikas Association, have condemned these practices and called for action against erring officials. A memorandum has been submitted to Chief Minister Devendra Fadnavis, highlighting the need for strict enforcement of PESA to protect tribal rights.

Despite initial negative resolutions from affected villages regarding land acquisition, officials have been pushing for reconsideration and new resolutions. A meeting was held on April 7 at Macher to provide detailed information and encourage villages to revisit their decisions.

The allegations of PESA Act violations in Maharashtra underscore the need for greater accountability among revenue officials. Ensuring that Gram Sabhas are respected and involved in decision-making processes is crucial for the effective implementation of PESA and the protection of tribal rights.
