Pune, 31 October 2025: Maharashtra’s Charity Commissioner Amogh Kaloti has overturned the controversial land sale of the Seth Hirachand Nemchand Memorial Trust (HND Jain Boarding), directing that the property be restored to the trust.
The decision cancels the earlier sanction granted on April 4, 2025, for the sale to developer Gokhale Landmarks LLP, and invalidates both the sale and the power of attorney executed in the developer’s favour.
As per the official order, the transaction between the trust and the developer stands completely nullified. The trust has been instructed to refund the sale proceeds, excluding the TDS amount, and to re-register the property in its own name.
The dispute arose over the alleged irregular sale of land historically dedicated to the welfare of Jain students and the community. Several Jain community members, including Akshay Jain, Anand Kankaria, Swapnil Gangwal, and Mahavir Chougule, contested the sale, citing misuse of charitable property. They produced documentary evidence that played a key role in the case.
Guided by Acharya Gurudev Guptinandi Ji Maharaj, a legal team comprising advocates Yogesh Pande, Anna Patil, Chandrakant Patil, and Sukoushal Jinturkar represented the community throughout the hearings. Their persistent legal efforts over the past five months ensured the matter was thoroughly examined.
In his ruling, Commissioner Kaloti declared that the land sale approval, sale deed, and related documents had no legal standing. He also ordered that both ongoing cases related to the matter (CC/08/2025 and CC/50/2025) be disposed of following this decision.
The Jain community in Pune has welcomed the verdict, describing it as a moral and legal victory that safeguards the trust’s heritage property for future generations.
