Pune Businessman’s Family Awarded ₹64.75 Lakh Compensation by MACT in Fatal Crash Case

Tribunal holds motorcyclist solely responsible for rash driving; directs joint liability with insurer and grants 9% annual interest

Pune, 30 March 2026: The Motor Accident Claims Tribunal (MACT) in Thane has awarded ₹64.75 lakh in compensation to the family of a 42-year-old Pune-based businessman who died following a road accident in 2022.

The order, passed on March 25 by MACT member RV Mohite, directs the motorcycle owner and a Thane-based insurance company to jointly pay the amount along with 9% annual interest from the date of filing the petition.

The deceased, Yuvraj Bhagawan Jagtap, ran an automobile servicing business in Pune. The accident occurred on November 24, 2022, near Chikhali when he was crossing the road and was hit by a speeding motorcycle. He suffered severe head injuries and died on December 13, 2022, during treatment.

His family, including his wife, two sons, and parents, filed a compensation claim. Although their estimated loss exceeded ₹2.19 crore, they formally sought only ₹1 lakh due to financial constraints at the time.

The insurance company opposed the claim, arguing that Jagtap was negligent while crossing the road and that the rider lacked a valid driving licence. However, the motorcycle owner failed to appear before the tribunal, and the case proceeded ex-parte against him.

After examining police reports and eyewitness accounts, the tribunal dismissed the insurer’s claims. It found that Jagtap was crossing the road carefully and that the accident was solely caused by the motorcyclist’s rash and negligent driving.

The motorcycle was being driven at high speed without regard for traffic conditions and hit the deceased. The tribunal also confirmed that the rider held a valid driving licence at the time of the accident.

While the family had claimed a minimal amount, the tribunal granted a higher compensation to ensure fairness. It assessed Jagtap’s monthly income at ₹35,000 and calculated the total amount considering future income loss, prospects, and medical expenses.

To secure the financial future of the dependents, the tribunal directed that a significant portion of the compensation be invested in fixed deposits in the names of his wife and children.
